If you die with a will your estate goes through probate or a probate proceeding. If you die without a will your estate will also go through probate. Probates take about two years and you need an attorney.

What is probate?

What happens during probate?
The court will decide on the validity of the will and announces the executor. The court also interprets the instructions of the will. Properties will be appraised and you are still responsible for paying debts and taxes.
